The Attorney-General of the Federation and Minister of Justice, Mr. Lateef Fagbemiro, SAN, has formally taken over the prosecution of his immediate predecessor, Abubakar Malami, SAN, in the alleged terrorism and illegal firearms case filed against him by the Department of State Services (DSS).
Fagbemiro, SAN, assumed control of the trial at the commencement of proceedings before the Federal High Court in Abuja, taking over from the DSS.
Through the Director of Public Prosecution of the Federation, Rotimi Oyedepo, SAN, Fagbemiro formally announced the federal government’s appearance in the matter.
During proceedings, Oyedepo informed Justice Joyce Abdulmalik that the trial could not proceed immediately, as the Attorney-General needed time to review the case to take an informed decision on the prosecution strategy.
Malami, represented by Adedayo Adedeji, SAN, expressed displeasure over the delay and asked the court to strike out the charge at the next adjourned date if the federal government failed to proceed without justification.
In response, Oyedepo described the request as premature and urged the court to disregard it.
After hearing submissions, Justice Abdulmalik adjourned the matter and fixed March 10, 2026, for the commencement of the trial.
