Ogun election tribunal: PDP’s star witness presents controversial electronic ‘evidence’

Published

on

In continuation of the proceedings at the governorship election petition tribunal sitting in Abeokuta metropolis, the Peoples Democratic Party (PDP) on Wednesday called  its star witness, who came with some downloaded electronic materials.

The star witness, Oyejide Sunkanmi, appeared before the panel with electronic evidence which purported to show alleged disruption of electoral process as claimed by PDP earlier, as well as printed materials presumed to have contained evidence of crime committed in Florida by Governor Dapo Abiodun and attendant jail term.

In their reactions, Counsel to Respondents raised  strong objections on the originality and authenticity of the  electronic materials, particularly the purported video, presented by the PDP’s star witness as evidence.

They queried the materials on the ground that in the first instance, the star witness admitted in his written statement that he was not the originator of the materials, rather, the purported evidence was downloaded. They argued that a video that was captured by someone else could not be tendered by the star witness, as to do so would be to accept inadmissible hearsay evidence.

Respondents counsel further argued that the authenticity of any document being tendered must be established, which was the essence of the legal requirement that such documents must be covered by a certificate of compliance.

The respective Counsel added that at no time were downloaded evidences being considered and acceptable in the court of law, and that in this instance the video was not pleaded or listed and that the transcript of the video which the witness had attached to his Certificate of Compliance was not even mentioned at all in the witness’ statement on oath. This was even as the Counsel to Petitioners assiduously encouraged the tribunal to accept the materials as evidence.

At the end of the day, the letter written by the PDP and the witness’ voters card was  admitted as an exhibit of the Court.

With respect to the pictures tendered, top up cards, and Florida Metropolitan Police Jail Incident Record, the Tribunal marked them with Exhibit Numbers while Respondents’ counsel reserved their objections for the final address stage, as had been the case for other contentious documents.

Ruling on the admissibility of the video was reserved to be delivered on Thursday.

APC professionals hail apex court ruling on LG autonomy

Published

on

The All Progressives Congress(APC) Professionals Forum says the Supreme Court ruling that affirmed Local Government autonomy will shore up development at that tier of government.
Dr Isa Yuguda, Chairman of the forum’s Board of Trustees, in a statement on Thursday in Abuja, said that the ruling was one of President Bola Tinubu’s major gifts to Nigeria’s democratic growth.
Yuguda said that the forum, like many Nigerians, had always wondered why state governments had, over the years, held on to funds meant for local government administrations, contrary to constitutional provisions.
He said that the development was more painful in recent months because, in spite of a quantum leap in allocations from federal purse to states and local governments, there was no commensurate improvement.
He regretted that since Tinubu assumed office, there had not been much improvement in development at state levels, let alone at the grassroots.
“This was why we supported the president’s position on the local governments, especially the decision to sue the 36 state governors over alleged misuse of local g9overnment funds.
“Now that the Supreme Court has affirmed our position and declared it unconstitutional for governors to hold on to local government funds, we praise Tinubu for testing the matter in court,” Yuguda said.
He recalled that Tinubu, as Governor of Lagos State, took the Federal Government to the Supreme Court on multiple occasions on constitutional matters.
“For our group, the court’s affirmation of local government autonomy is the first step towards grassroots development because that tier will now have direct access to funds statutorily allocated to them.
“This is good for democracy and is bound to increase fund allocations to the third tier of government,” the statement said,
He said Tinubu should be applauded for actualising what his predecessors could not.

Political entrepreneurs behind crisis in political parties — A.A Nat’l Chair

Published

on

By: Austine Emmanuel, Kaduna

National Chairman of the Action Alliance (A.A) Party, Hon. Adekunle Rufai Omo-Aje has disclosed that political bigwigs are the ones sponsoring crisis in some political parties in Nigeria.

Omo-Aje asserted this in a statement made available to journalists in Kaduna, on Wednesday said that political bigwigs often sponsor former political members to cause chaos so as to distract leaders from carrying out developmental strategies as panacea to sustainable growth within the party.

The Chairman, who congratulated Comrade Edozie Njoku on his recent victory at the Supreme Court declaring him as the authenticated National Chairman of the All Progressive Grand Alliance (APGA,) said it is an open secret that these bigwigs are behind the current crisis in A.A.

He added that the needed justice would remain elusive, but the bold move by the Independent National Electoral Commission (INEC,) to recognize Comr. Edozie as the National Chairman of APGA is a welcome development.

Omo-Aje noted that “the Wheel of Justice Grinds Slowly But Exceedingly Fine,”  the philosophy acknowledges the frustrating, often slow pace of getting justice but advises patience because eventually justice will be served.”

According to him, the leadership tussle bedevilling some political parties in Nigeria such as Action Alliance (AA), and All Progressive Grand Alliance (APGA), among others, will make one understand the impact of the above popular saying.

He stressed that just like APGA, the Action Alliance has been involved in the leadership tussle for a long time since in 2017 while APGA began her ‘Political Civil War’ a little over 6 years ago.

“I referred to the problem within APGA as a political civil war because the political tussle when it lasted was among the members of the political party, while the onslaught on our Party is from outsiders,” he stated.

According to him, it is no longer a secret that political bigwigs are the ones sponsoring the former members of A. A to disrupt the governance and political activities of the party.

However, he maintained that the Wheel of Justice will eventually grind finely for Action Alliance as it ground fine for APGA, adding that he believes in the Justice System of Nigeria to always favour the truth.

“Both the Greek and Chinese ancient philosophers are ascribed with the ancient wise saying that ‘The Wheel of Justice Grinds Slowly But Exceedingly Fine,’ the philosophy acknowledges the frustrating often-slow pace of getting justice but advises patience because eventually justice will be served.

“Comrade Edozie Njoku eventually got justice after getting a judgement in his favour from one court to another even to the Supreme Court yet it seemed as if the needed justice would remain elusive but the bold move by the INEC to recognize him as the genuine Chairman is a welcoming development.

“I congratulate Hon. Edozie Njoku and his National Executive,  I admire their doggedness and persistence to get the deserved justice.

“I am using this opportunity to thank all our members who have been unwavering in their support and loyalty. I assure you again,  both Barrister Kenneth Udeze and his sponsors have met more than their match in me and my team.

“Let’s not fight or be angry with those who abandoned the ship when it seems the ship is leaking. Let us be more understanding and tolerate them, more especially to those who are sitting on the fence.

“Just like our brother from APGA, We also have a Supreme Court ruling affirming that Barrister Kenneth Udeze and his accomplice Mr James Vernimbe are not our members. THE SAME SUPREME COURT!”

“It may be delayed but I am confident that the Wheel of Justice will grind finely for us in Action Alliance. Once again, I assure you that I won’t stop leading you even from the battlefront until we conquer both the enemies within and without.”

The Peoples Democratic Party (PDP) has suspended its National Vice Chairman (South South), Chief Dan Orbih over his alleged actions and utterances on Edo governorship primary election of the party.

The party disclosed this, in a statement, by its National Publicity Secretary, Debo Ologunagba in Abuja on Wednesday.

Ologunagba said that the National Working Committee (NWC), at its 588th meeting on Wednesday, July 10,;considered all issues, including complaints on the activities of Orbih, concerning the Sept. 21 election.

According to him, the NWC, at the meeting, unanimously condemned the embarrassing actions and utterances of Orbih relating to the Edo State Governorship Primary Election of PDP.

“The actions and utterances are inconsistent with the provisions of the Constitution of the PDP (as amended in 2017) and the demand of his office as a national officer of the party.

“Consequently, the NWC has set up a six-member committee headed by the Deputy National Chairman (South), Amb. Taofeek Arapaja, to investigate the issue pursuant to the provisions of the Constitution of the party.

“In the meantime, the NWC forthwith suspends Chief Dan Orbih from participating in all meetings, activities and programmes of the NWC, pending the conclusion of the investigation by the committee,” he said.

Ologunagba added that the NWC acknowledged the support and solidarity of the overwhelming majority of the people of Edo who rallied round the PDP and its Candidate, Dr Asue Ighodalo.

He charged all PDP leaders, critical stakeholders and members in Edo to remain united, focused and continue to work hard for the victory of PDP and its candidate in the upcoming election.
