Court nullifies Obasa’s removal as Speaker, rules action unconstitutional

The Lagos State High Court in Ikeja has invalidated the removal of Mudashiru Obasa as Speaker of the State House of Assembly, declaring the process unconstitutional, illegal, and a breach of due legislative procedure.

Delivering judgment on Wednesday, Justice Yetunde Pinheiro nullified all proceedings and resolutions of the January session during which Obasa was controversially removed, insisting that the Assembly acted outside the bounds of its constitutional and procedural authority.

“This court finds that the removal of the claimant, Mudashiru Obasa, was done in violation of the laid down procedures of the Lagos State House of Assembly and is therefore null, void, and of no legal effect,” Justice Pinheiro ruled.

Recall that Obasa, who filed the suit against the Assembly and Mojisola Meranda, his replacement challenged the legitimacy of the session that led to his ouster, arguing that it was convened while the Assembly was on recess and he was out of the country on official assignment.
