Regulatory uncertainty poses major hurdle for prospective investors — NMDPRA

The Nigerian Midstream and Downstream Petroleum Regulatory Authority (NMDPRA) has identified regulatory uncertainty as a primary challenge for prospective investors, stating that while businesses are equipped to manage commercial risks, policy unpredictability makes committing capital far more difficult.
The Authority stated that investors need clear rules, consistent decisions, and predictable regulatory processes to have confidence in making long-term investments.
The NMDPRA highlighted this while emphasizing the importance of regulatory certainty to the development of Nigeria’s midstream and downstream petroleum sectors.
According to the Authority, while governments can introduce fiscal incentives, financing support, and policy reforms to attract investment, such measures may have limited impact if investors are uncertain about how regulations will be applied.
The Authority noted that this is particularly important for investments in refineries, pipelines, storage facilities, and gas infrastructure, as such projects require substantial capital and are expected to operate over many years.
It said investors typically want to know whether regulatory approvals will be issued on time, whether regulations will be applied consistently, and whether regulatory institutions can make fair and predictable decisions.
The NMDPRA said the Petroleum Industry Act (PIA) provides Nigeria’s petroleum industry with a legal and regulatory framework based on transparency, competition, and accountability.
It added that its responsibility is to ensure these principles are reflected in its day-to-day regulatory activities.
The Authority stated that effective regulation goes beyond issuing licenses and enforcing compliance, as predictable regulation allows businesses to plan, invest, and operate with greater confidence.
It also said it is strengthening collaboration with other government institutions, noting that effective regulation requires not only sound policies, but also consistent implementation.
According to the NMDPRA, every license issued, inspection conducted, and regulatory decision made contributes to confidence in Nigeria’s regulatory system.
The Authority concluded that it would continue engaging industry stakeholders as it works to strengthen the country’s midstream and downstream petroleum sectors.
