FCCPC sues MultiChoice over subscription price hike

The Federal Competition and Consumer Protection Commission (FCCPC) has taken legal action against MultiChoice Nigeria Ltd. and its Chief Executive Officer, Mr John Ugbe, for allegedly violating regulatory directives.

In a statement issued on Wednesday in Abuja, the FCCPC’s Director of Corporate Affairs, Mr Ondaje Ijagwu, disclosed that the company was also charged with obstructing an ongoing inquiry and engaging in conduct that contravenes the Federal Competition and Consumer Protection Act (FCCPA) 2018.

According to the commission, MultiChoice Nigeria was directed on 27 February to maintain its current pricing structure for DStv and GOtv while regulatory scrutiny of its proposed price hike was underway. However, the company went ahead with the increase on 1 March, in direct violation of the directive.

“As a result of this disregard for regulatory oversight, the FCCPC has filed charges against MultiChoice Nigeria and Mr John Ugbe at the Federal High Court, Lagos Judicial Division,” the statement read.

The charges include: “Obstructing a regulatory inquiry by implementing the price hike in defiance of instructions (Section 33(4) of the FCCPA 2018). Impairing an ongoing investigation by failing to suspend the increase as directed (Section 110).

“Attempting to mislead the commission by enforcing the hike without challenge (Section 159(2)), an offence punishable under Section 159(4)(a) and (b). Undermining Consumer Protection and Market Fairness.”

The FCCPC described MultiChoice Nigeria’s actions as deliberate and calculated, aimed at weakening regulatory authority, distorting market fairness, and depriving consumers of legal protections.

Beyond disregarding regulatory processes, the commission accused the company of consistently undermining consumer rights and fair competition.

“In light of these infractions, the FCCPC is evaluating further enforcement measures, which may include sanctions, financial penalties, and regulatory interventions to ensure compliance and accountability,” the statement added.

The commission reaffirmed its commitment to safeguarding consumers against exploitative business practices, ensuring that dominant market players uphold fair competition and adhere to legal regulations.
