Estate coy drags tenant to court for allegedly refusing to vacate property

A real estate company, MAMSTI integrated Nig. Ltd, on Thursday dragged its tenant, Ben Mercy before the Chief Magistrates’ Court in Mararaba, Nasarawa State for allegedly refusing to vacate their premises.

Mercy resides at Abacha Road, Otukpa Street Zamani behind White House Abacha road Mararaba, Nasarawa State.

The Managing Director of the firm, Mr Idoga Moses told the court that the defendant was a yearly tenant who lived in a self-contained room with rent of N750,000 per annum.

The tenancy, he said, ran from Nov. 13, 2024, to Nov. 12, 2025.

Moses alleged that before the defendant moved in, he pleaded with the management to allow him pay in installments and they agreed.

“After moving in, he refused to pay his monthly metre fees of N7,000 and security levy of N5,000 monthly for 19 months.

“He used the estate generator to pump water without contributing for diesel,” he told the court.

Moses further alleged that the defendant on May 13, had an altercation with his male friend and they broke a glass window worth N50,000.

He said he served the defendant three-month quit notice and a seven days but defendant refused to vacate or return the property in the condition it was rented to him.

He therefore prayed the court for an order directing the defendant to vacate, and to pay N62,500 monthly as mesne profit from Nov. 12, 2025, until possession is delivered.

Other claims include N7,000 monthly meter fees, N5,000 monthly security levy from Nov. 13, 2024, N50,000 for the broken window, and N250,000 as cost of instituting the action.

The Chief Magistrate, Mrs Joy Faruk, adjourned the matter until July 21 for continuation of hearing.
