A 29-year-old man Samuel Balogun found himself before an Akure Magistrate’s Court in Ondo State on Monday, facing charges of assaulting two policemen at Ifira-Akoko in Akoko South-East Local Government Area of the state.
The prosecuting counsel, Mr. Itunu Osobu, informed the court that Balogun, along with accomplices who are still at large, allegedly assaulted the policemen on January 28, 2022, while they were carrying out their lawful duties.
Osobu disclosed that he had eight witnesses prepared to testify against Balogun and requested the court to remand the defendant while setting a date to commence the case.
Expressing concerns over potential flight risks and witness intimidation, Osobu argued against granting bail to Balogun, citing previous unsuccessful attempts by the police to apprehend him in connection to a petition. He emphasised that Balogun was only apprehended after being found in possession of illegal firearms.
In a counter-motion, Balogun’s defense counsel, Mr. A.O Olahanmi, pleaded for bail on behalf of his client, urging the court to consider liberal terms. Olahanmi expressed willingness to proceed with the case upon setting a hearing date.
The court proceedings shed light on the gravity of the allegations against Balogun and the legal battle ahead. The case underscores the importance of upholding the rule of law and ensuring accountability for acts of violence against law enforcement officers.
Olahanmi argued that the offences levelled against his client were bailable and that Balogun had a right to bail.
He assured that Balogun would provide reliable sureties for the bail, and would make himself available for trial.
Presiding Magistrate O. W. Dosunmu ordered that Balogun be kept in police custody and adjourned hearing of bail arguments to March 27.
