Mother, son docked in Osun over alleged assault on Police officer

The Osun State Police Command, on Monday, arraigned a 65-year-old woman, Otitola Adunni, along side her son, Otitola Damilare Stephen 34-years-old over alleged assault on police officer while on duty in Osogbo, state capital.

The defendants including teenager, Ismaila Abdullahi were docked before Magistrate, E.O Aluko on a three count charge bordering on Assault, breach of peace and reckless driving.

The prosecutor, Inspector Adeoye Kayode told the court that the defendants committed the offense on the 21st January 2023 at BCGA area Osogbo.

He said that defendants conducted themselves in a manner likely to cause a breach of peace.

He started that the 2nd defendant, one Otitola Stephen in charge of a Toyota Avensis broke the traffic rules by reckless driving on a one-way route putting lives of others in danger.

According to the charge sheet, the offenses committed are contrary to and punishable under section 356, 249(d) and 18(1) of the criminal code CAP 34 vol. ii and RTR CAP 113 vol, 5 laws of Osun state of Nigeria 2002.

Counsel to the defendants, B.Y Dada pleaded for bail of the 1st and 2nd defendant in the most liberal and affordable terms. She said the defendant will provide  reliable suretees if granted.

Similarly, Counsel to the 3rd defendant, Najite Okogbe, also applied for the bail of the 3rd defendant, if admitted by the court.

The prosecutor, objected to the bail applied by the defendant counsel, stating that the attitude is very rampant in the society, saying many police officers are being assaulted while discharging their rightful duties.

Barrister Dada then argued that there are certain offences where bail is not an option especially in a capital offence, and accused the prosecutor of been sentimental in his objection to the bail.

The magistrate, E.O Aluko granted the defendants bail in the sum of N100,000 with two sureties in like sum, and adjourned the case till 21st day of February 2023, for trial.
