Lagos hails S’Court judgement ceding lotteries, gaming regulation to States

The Lagos State Government has celebrated a landmark ruling by the Supreme Court in Suit No. SC/1/2008, which reaffirms the constitutional authority of state governments to regulate lotteries and gaming activities within their territories.

The decision, which nullifies the National Lottery Act, strengthens the principles of federalism by emphasising the residual power of states in such matters.

In a statement issued on Sunday, Lagos State Commissioner for Information and Strategy, Gbenga Omotoso, hailed the judgement as a significant victory for the rule of law and constitutional democracy.

Omotoso stressed that the Supreme Court’s decision clearly affirms that the regulation of lotteries and gaming is a matter under the exclusive purview of state governments.

“This ruling reinforces the principles of true federalism, empowering states to develop their own regulatory frameworks for gaming activities,” Omotoso stated. “It is a historic triumph for Lagos State and the rule of law.”

Omotoso further praised the judgement as a reflection of President Bola Tinubu’s vision for true federalism, calling the decision “a fitting tribute to his progressive leadership.”

He also credited former Governor Babatunde Raji Fashola, SAN, for his efforts in addressing constitutional issues that ultimately led to this legal victory.

Lagos Governor Babajide Sanwo-Olu was also commended for his dedication to safeguarding the rights of the state’s residents and upholding the rule of law throughout the case.

The ruling has solidified the position of the Lagos State Lotteries and Gaming Authority (LSLGA) as the sole regulatory body for gaming activities within the state. Omotoso urged illegal operators to regularise their businesses with the LSLGA or face legal consequences.

“The Lagos State Government is committed to fostering a conducive environment for legitimate businesses while ensuring that the gaming sector contributes to the state’s economic growth,” Omotoso said.

He emphasised the government’s determination to protect residents from the harmful effects of unregulated gaming activities.
