Court orders police to investigate Abuja tax collector

An Upper Area Court in Kubwa, on Wednesday ordered the Police to investigate a case of alleged public nuisance filed against a tax collector, Masel Onyebuchi of Celebrity Kitchen.

The judge, Malam Yahaya Sheshi, gave the order pursuant to Section 89(5) of the Administration of Criminal Justice Act (ACJA) which provides the court may refer a direct criminal complaint to the police first before taking any step in the matter.

The direct criminal complaint instituted by the complainant, Mr Etim Udoh was, however, referred to the Police Area Command in Kubwa.

Udoh of Federal Housing Authority, Kubwa, brought the said complaint to the court, saying that Onyebuchi, his neighbour, runs a beer parlour in the said area.

The complainant stated that he lives in a residential area but Onyebuchi constantly plays loud music from 8am till dawn daily, disrupting his and his family’s sleep.

He alleged that the loud noise from Onyebuchi’s Celebrity Kitchen has continuously caused him insomnia and migraine.

The complainant claimed that Onyebuchi’s act constituted the offence of conspiracy, public nuisance and breach of peace, contrary to Sections 97, 198 and 114 of the Penal Code.
