Court orders aluminum fabricator to return customer’s N759,000

An FCT Upper Area Court has ordered an aluminum fabricator, Yekini Tunde to pay N759, 000 to a businessman for a job he didt do or face sentence.
The police charged Tunda who resides in Sabo-Iddo, Abuja with criminal breach of trust and mischief.
Delievring judgment, the judge, Malam Abdullahi Abdulkarim saidL” the defendant is released on probation to Correctional Service Officers. He is to report twice a week every monday and wednesday to the Correctional Service.
“The defendant is also ordered to pay N200,000 only monthly to the nominal complainant until final instalment of N759,000”, he ruled.
Abdulkarim said that if the defendant defaults  to meet the conditions given, he should be brought back for conviction and sentencing.
Earlier, the Prosecution Counsel, Dabo Yakubu told the court that Oluwaseun of Seman Estate Airport road Abuja reported the matter at Iddo police division on June 16.
Dabo said the complainant in April asked the defendant to fabricate 26 aluminum windows at Seman estate Abuja.
He said that N1.4 million was paid to the defendant for the work .
The police said that the defendant only completed work on 12 aluminum windows.
He said that the windows done were not properly fixed which resulted to damages on the windows, adding that the defendant deceived the complainant and collected an additional N150,000 to complete the work.
He said that the defendant dishonestly converted the money his personal use without doing the work.
The prosecutor said that the offence contravened the provision of sections 312 and 327 of the Penal Code.
