Court issues bench warrant against mechanic for alleged cheating
A Grade I Area Court, Kubwa, has issued a bench warrant authorising the arrest of a mechanic, Mr Christian Tubaba for alleged cheating.
The complainant, Mr Mazi Amaralam had filed a direct criminal complaint against the defendant for alleged criminal breach of trust and cheating.
The Judge, Yahaya Sheshi said that he had seen the proof of service showing that the court summons had been served on the defendant on Feb.2.
Sheshi however issued the warrant authorising the arrest of the defendant and adjourned the matter until Feb.15 for hearing.
The complainant had alleged that he gave the defendant of Byazhin across, Kubwa,his Peugeot 406 car for repairs on Dec.10.
Amaralam said the defendant gave him an estimate of N48, 000 for repairs and his labour.
He added that the defendant stated that he bought engine oil valued N9, 500, oil filter N1000, wheel spanner for N6,000 and N16, 000.
The complainant said the defendant refused to repair the vehicle after dismantling the car engine.
He however prayed for the court to charge the defendant for the said offence and award a compensation of N81, 000.
The offence of criminal breach of trust and cheating contravenes the provisions of sections 312 and 322 of the Penal Code.
According to section 312, whoever commits criminal breach of trust shall be punished with imprisonment which may extend to seven years or with a fine or both.
Section 322 states that whoever cheats shall be punished with imprisonment for a term which may extend to three years or with fine or both.
