Court dismisses ex-Ogun NNPP chair’s suit challenging his expulsion
A Federal High Court sitting in Abeokuta, Ogun State, has dismissed a suit filed by former Chairman of New Nigeria People’s Party (NNPP) in the state, Comrade Olaposi Oginni, challenging his expulsion by the leadership of the party.
Newsmen recalls that the national leadership of the party has earlier expelled the former chairman over anti-party activities.
Our correspondent reports that the explusion of the chairman was announced by the national leadership of the party.
The party maintained that the chairman was expelled after the National Working Committee (NWC) of the party set up a disciplinary committee to investigate the matter.
But Oginni who was dissatisfied with the decision of the national leadership of the party, filed a suit at the Federal High Court challenging their authority to expel him.
Newsmen, however, gathered on Monday that the former chairman has lost out in his bid to return as the chairman of the party in the state.
The court, under the leadership of Justice Adefunmilola Demi-Ajayi, dismissed the suit filed by the former chairman.
It added that the former chairman has no right to return to his former position.
Demi-Ajayi, while delivering his judgement in the suit No: FHC/AB/CS/21/2023, where Oginni was the plaintiff while NNPP is the 1st defendant, NWC of the NNPP is the 2nd defendant and the INEC was the 3rd defendant, said the originating summon was found to be lacking in merit.
The judgement reads, “This Court, therefore, finds and holds that this matter is not pre- election matter, it is an intra-party affair; the court, therefore, has no jurisdiction as to the matter.
“The matter must be settled as a family matter. The originating summon is found to be lacking in merit, the objection of the defendants/applicant is found to be meritorious and is thefore upheld.
“The originating summons is, therefore, dismissed. Each party shall bear its own costs”.
